Commercial Contract Renegotiation
We assisted a client in the renegotiation of a long-term commercial distribution contract. The client distributed and marketed its partner’s products throughout the United States. When the partner’s sales declined, cooperation on marketing and pricing deteriorated, and the partner took actions to argue our client’s breach of the agreement, ultimately stating its wish to terminate the agreement altogether.
We helped our client think through the interests and no-agreement alternatives of both parties in a systematic way with special attention to their partner’s business strategy. We then helped them craft a negotiation strategy that they successfully implemented.
